The 9th Circuit Court of Appeals ruled yesterday that Unaccompanied Children held in detention by the Office of Refugee Resettlement are entitled to bond redetermination hearing, the same as any other detained immigrant. The Trump administration argued that the children did not have a right to a day in court and that they could be detained without court oversight.

The 9th Circuit said that the Department of Homeland Security was violating the Flores settlement agreement which specifies the rights of those in detention, including the right to appear in court. Since President Trump’s immigration executive orders were issued, Homeland Security has insisted that child refugees are clothed with few rights.
