Fund for Excluded Workers May Run Out of Funds in October

The new New York State Excluded Workers Fund is likely to run out of funds in October or November. By early September half of the funds had already been expended and the number of new applications has continued to rise. As can be seen in the following graph, the largest single-day number of applications were filed on Sept. 20, 2021.

The Fund originally had 2.1 Billion Dollars in it. A surprisingly large number of applications were submitted from the earliest days of the program. New York State’s Department of Labor [DOL] cannot predict when the fund will run out of money, but the day will likely come very quickly. Beginning Friday, the DOL will post a notice for new applicants informing them that they might not receive money from the Fund if it runs out.

Anyone who has the necessary documentation but has not yet filed, should do so immediately. Filing today or tomorrow is strongly recommended.
