
The Department of Justice (DOJ) will file what is known as an emergency stay, which will override the preliminary injunction issued by a Texas judge on Monday night. The judge’s decision prevented the government from implementing the program. Applications for the expansion of DACA, which had been set to begin this past Wednesday, are now delayed.
White House press secretary Josh Earnest said, “We will seek that appeal because we believe when you evaluate the legal merits of the arguments, that there is a solid legal foundation for the president to take the steps he announced last year to help reform our immigration system.”
The DOJ is expected to file for the stay by Monday.
